Notes
Per Dr. Robert A. Herring, MD (1969)...pp. 32-33 "Conclusive evidence relative to the paternity of John Herring, Jr., which establishes him as the son of John Herring, Sr., is a scrap of paper among deeds and other papers relating to the property in the possession of Needham Whitfield Herring, the owner of part of the Herring homeplace in Lenoir County, N. C., in 1926, and seen by this writer in that year. This was a remnant of a conveyance by "John Herring, son of John Herring, Sr., dec'd. and ----- Herring, Joshua Herring, and Benjamin Herring." The name which was torn off was Simon Herring. This paper, being only a remnant of the original, does not show the details of the conveyance or its date. The nature of the paper, however, indicates that it may have been a conveyance of land entered into by the sons of John Herring, Sr. If this is correct, it maybe, that in addition to Joshua and John Herring, Jr., Simon Herring and Benjamin were sons, also. Reference was made in the section on John Herring under discussion of his children to the military service of Joshua Herring, Simon Herring, and Benjamin Herring, recorded in the Colonial Records as officers in the Johnston County Foot under Col. Lewis de Rosset in the years 175é and 1755. This suggests that these three were not far apart in age, that Joshua was perhaps the youngest of the three since he held the lesser rank, and that on the basis of these facts they could have been brothers. However, beyond these collateral facts, there is little other authentic record of either Simon or Benjamin Herring during the Colonial period and nothing definite, actually showing them to be the sons of John Herring and therefore brothers of Joshua Herring and John Herring, Jr. As the brother of Joshua Herring, John Herring, Jr., obviously was older than Joshua, being perhaps the oldest and first son of John Herring and born early in the 1700's, since, as he was repeatedly of record as John Herring, Jr., it is frequently the custom to name the first-born son after his father and to apply the designation of junior to his full name. That he was considerably older than Joshua is evident since a deed executed by him/1729 in Bertie County would place him above his majority in that year else he would not have been legally qualified to execute a deed. As Joshua Herring's birth is recorded as l723, the above would indicate that John Herring, Jr., was born soon after the year 1700, and was therefore considerably older than Joshua. It is probable also that if Simon and Benjamin Herring were sons of John Herring and brothers of John Herring, Jr., and Joshua, they very likely stood between John Herring, Jr., and Joshua in age."
